Terms of Service — Northline Tennis Studio

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services, programs, facilities, communications, and related offerings provided by Northline Tennis Studio (“Northline Tennis Studio,” “we,” “us,” or “our”). By booking, registering for, purchasing, attending, or otherwise using any of our services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. If you are using our services on behalf of a minor, you represent and warrant that you are the parent or legal guardian of that minor and that you accept these Terms on the minor’s behalf.
2. Scope of Services
Northline Tennis Studio provides tennis-related instruction and support services, which may include:
- Private tennis lessons
- Group coaching clinics
- Junior development programs
- Adult beginner programs
- Match strategy and performance training
- Serve and stroke analysis
- Court booking assistance
Services may be delivered in person, by video analysis, by phone, by email, or through other communication methods as reasonably required. We may modify, suspend, or discontinue any service at any time, subject to applicable law and any pre-paid commitments already made.
We do not guarantee specific athletic, competitive, or performance outcomes. Any training, coaching, or analysis provided is educational and advisory in nature and depends on many factors outside our control, including the participant’s effort, physical condition, and consistency of practice.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete registration and contact information;
- Comply with all instructions, rules, policies, and safety directions provided by Northline Tennis Studio, venue operators, coaches, and staff;
- Ensure that you and any minor participant are physically and medically fit to participate in tennis activities;
- Disclose any relevant medical conditions, injuries, allergies, or limitations that may affect participation;
- Use appropriate tennis attire and equipment as required for the activity;
- Respect other participants, staff, coaches, facilities, and equipment;
- Refrain from abusive, disruptive, discriminatory, harassing, or unsafe conduct;
- Not misuse booking systems, payment systems, or any content or materials provided by us.
You are responsible for your personal property, including racquets, phones, valuables, and other belongings brought to any lesson, clinic, or facility. Northline Tennis Studio is not responsible for lost, stolen, or damaged personal property except to the extent required by applicable law.
Participation in tennis activities involves inherent risks, including but not limited to slips, falls, collisions, overuse injuries, dehydration, weather-related hazards, equipment failure, and injuries caused by other participants or third parties. You acknowledge and voluntarily assume these risks to the fullest extent permitted by law.
4. Payment Terms and Conditions
Fees for services will be communicated at the time of booking, registration, or purchase. Unless otherwise stated, all prices are in Canadian dollars (CAD) and are subject to applicable taxes, including GST/HST where required by law.
- Payment may be required in advance to confirm a booking or registration.
- We may refuse or cancel a booking if payment is not received or if payment is reversed, declined, or disputed.
- Any discounts, promotions, or package pricing are subject to the specific terms offered at the time.
- Unused sessions, credits, or packages may expire if not used within the stated validity period, or if no validity period is stated, within a reasonable period determined by Northline Tennis Studio in accordance with applicable law.
You authorize us, or our payment processor, to charge the payment method provided for all fees, taxes, late cancellation charges, no-show fees, and other amounts due under these Terms.
If a payment is overdue, we may suspend services, cancel bookings, and recover reasonable collection costs and applicable interest where permitted by law.
5. Cancellation and Refund Policy
Cancellations and rescheduling requests must be made in accordance with the notice period communicated at booking or registration. If no specific notice period is stated, the following default policy applies unless prohibited by applicable law:
- Private lessons: At least 24 hours’ notice is required to cancel or reschedule without charge.
- Group clinics and programs: Cancellations made less than 48 hours before the scheduled start may be non-refundable.
- No-shows: Failure to attend a scheduled session without proper notice may result in forfeiture of the session or a no-show fee.
Refunds, if any, are issued at our discretion and in accordance with applicable consumer protection laws in Ontario and Canada. Refunds may be limited or unavailable for:
- Completed sessions or partially used packages;
- Late cancellations or no-shows;
- Services already delivered, including video analysis or court booking assistance;
- Promotional, discounted, or non-refundable offerings, where clearly disclosed.
If Northline Tennis Studio cancels a session due to coach unavailability, weather, facility closure, safety concerns, or other operational reasons, we will make reasonable efforts to reschedule or provide a credit or refund, as appropriate and subject to applicable law.
For junior programs and group activities, we may substitute coaches, adjust schedules, or modify formats when reasonably necessary to maintain service continuity.
6. Liability Limitations
To the fullest extent permitted by applicable law, Northline Tennis Studio, its owners, directors, officers, employees, contractors, coaches, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, or loss of opportunity, arising out of or related to your use of our services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or related to the services shall not exceed the amount paid by you to Northline Tennis Studio for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or CAD $100, whichever is greater, unless a higher amount is required by applicable law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, fraud, or any other liability that cannot legally be limited.
You acknowledge that tennis activities may involve physical exertion and risk. You are responsible for consulting a physician or other qualified healthcare professional if you have concerns about your ability to participate safely.
7. Intellectual Property Rights
All content provided by Northline Tennis Studio, including but not limited to lesson plans, drills, training materials, videos, written materials, graphics, logos, trademarks, service marks, and website content, is owned by or licensed to Northline Tennis Studio and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use materials provided to you solely for your personal, non-commercial use in connection with our services. You may not reproduce, distribute, modify, publicly display, sell, sublicense, or otherwise exploit any materials without our prior written consent.
Any feedback, suggestions, or ideas you provide to us may be used by Northline Tennis Studio without restriction or compensation, unless otherwise required by law.
8. Data Protection and Privacy
Northline Tennis Studio collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
We may collect personal information such as your name, contact details, emergency contact information, age or date of birth for junior programs, payment information, health or injury information relevant to participation, and service preferences.
We use personal information to:
- Register and manage bookings, lessons, clinics, and programs;
- Communicate with you about schedules, payments, and service updates;
- Provide coaching, training, and related support services;
- Maintain safety, operational, and administrative records;
- Comply with legal and regulatory obligations;
- Improve our services and customer experience.
We may share personal information with service providers, payment processors, venue operators, or other third parties only as reasonably necessary to provide our services or as otherwise permitted or required by law.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in these Terms and in any separate privacy notice we may provide. If there is any inconsistency between these Terms and a privacy notice, the privacy notice will govern with respect to privacy matters.
9. Force Majeure
Northline Tennis Studio shall not be liable for any delay, failure, or interruption in performance caused by events beyond our reasonable control, including but not limited to severe weather, fire, flood, power outages, labour disputes, government actions, public health emergencies, facility closures, transportation disruptions, equipment failures, or acts of God.
In the event of force majeure, we may reschedule, suspend, or cancel services without liability except as otherwise required by applicable law or expressly stated in a written service-specific policy.
10. Changes to Terms
We may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The revised Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Ottawa, Ontario, Canada, subject to any mandatory consumer protection rights or other non-waivable rights under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be deemed modified to the minimum extent necessary to achieve that result, consistent with applicable law and the original intent of the provision.
